General

Sky Blue Web Design will carry out work for clients who are 18 years of age or over. Should a client be under the age of 18 years full written authorization from a parent or guardian will be required before any work is carried out and parental approval of the finished website will also be required before the design is released. After the release of the website Sky Blue Web Design can not accept responsibility for any alterations made by any other web designer.

Work will only commence when a written order is received. A confirmed order is deemed to be a written agreement between the client and Sky Blue Web Design either by letter or email.

The client agrees to make available as soon as reasonably possible all materials required to complete the site within any set deadlines. Sky Blue Web Design will not be held responsible for costs incurred, loss of earnings or compensation due to the client failing to meet any agreed deadlines.

Sky Blue Web Design reserves the right to change/amend its terms and conditions at any time without prior notice.

Payment Terms

A 20% security deposit is required prior to any design work being undertaken. A further 30% will be required on completion of half the work required. The remaining balance will then become due once the website is completed and notice of completion has been issued to the customer. If the account is still outstanding after 30 days then a reminder will be issued. If after 60 days payment has still not been received, we will pass the matter onto our solicitors without any further reminders being issued. Our Solicitors will be instructed to contact the client, with a view to taking the matter further. All deposits are non refundable.

Cancellation and Refunds

Should the client wish to cancel the agreement they must do so in writing to Sky Blue Web Design. The client should note that the agreement has been terminated only when they have received an acknowledgement of cancellation from Sky Blue Web Design. All works carried out upto the point of cancellation will be charge at Sky Blue Web Design's current hourly rate. No amount of the initial 20% and 30% deposits are refundable.

Website Hosting

All our websites are hosted with telivo.com. Sky Blue Web Design offers no guarantees on the availability of this service. Sky Blue Web Design cannot be held responsible for any losses caused by the unavailability of this 3rd party service.

Offensive Material

Sky Blue Web Design reserves the right to refuse to handle any material which may be deemed offensive or illegal. If such material is found, Sky Blue Web Design reserves the right to terminate the agreement and may report the matter to the police. Sky Blue Web Design will not be held responsible for material added to the web site should the client choose to have the site maintained by an alternative web designer.

Maintenance

The initial design includes 3 months free maintenance package. During this time Sky Blue Web Design will update and maintain the website. If the client, or their agent (other than Sky Blue Web Design), attempts to update the website, the time taken by Sky Blue Web Design to repair the website is not included in the maintenance package and will be charged at Sky Blue Web Design's current hourly rate.

Design

Any cgi / php scripts, javascripts or software written by Sky Blue Web Design will remain the intellectual copyright of Sky Blue Web Design and may not be resold or commercially reproduced without the permission of Sky Blue Web Design.

The website code, custom graphics and any programming code will remain the property of Sky Blue Web Design until all outstanding accounts are paid in full.

Sky Blue Web Design cannot be held responsible for any copyright infringements caused by graphics and textual information material submitted by the client. We reserve the right to refuse any material of a copyrighted nature.

Changes made after work has commenced will be carried out at the discretion of Sky Blue Web Design and may incur additional charges.

Copyrights

The client guarantees that any text, images, graphics, photos or any other artwork supplied by the client for inclusion in the website is owned by the client or the client has permission to use the above mentioned work by the owner thereof.

Sky Blue Web Design retain the right to display the completed website in their portfolio as examples of their work.

Browser Compatibility

Every effort is made to ensure that the completed website is compatible with all current web browsers. We will attempt to ensure that any designed site will function correctly with the latest version of Microsoft Internet Explorer and Mozilla based browsers. However, we do not offer any guarantees of correct functionality with all browser software.
